What Is the Partner Visa (Subclass 309/100)?

The Subclass 309/100 Partner Visa is for applicants, outside Australia, who are in a married or de facto relationship with an eligible Australian sponsor.  You must be in a Genuine relationship with your Australian spouse and that spouse must sponsor you.

This visa is granted in two parts:
  • Subclass 309 – Temporary Partner Visa: This is the initial stage of the visa, allowing the applicant to live in Australia temporarily while their permanent visa is processed. You can work, study, and access Medicare during this time. The department fee for this visa 820/801 is 9365AUD for a primary applicant. You must be Outside Australia when you apply for this visa.
  • Subclass 100 – Permanent Partner Visa: This is the second stage and grants the applicant permanent residency in Australia, typically two years after lodging the Subclass 309 application.
